Terms and Conditions of Sale

1. Purpose

These Terms and Conditions of Sale govern all transactions carried out on the Edition-Originale.com website.
They comply with the legislation applicable to online commerce.
Any order placed through the website constitutes full and unconditional acceptance of these Terms and Conditions.

2. Items

The works offered for sale are described as accurately as possible.
Photographs provided are intended to complement the written descriptions. While an exhaustive description is not possible, Librairie Le Feu Follet – Edition-Originale.com undertakes to detail the condition and particular characteristics of each item with care and accuracy.

Items presented on Edition-Originale.com are offered for sale subject to availability from the stock held by Librairie Le Feu Follet – Edition-Originale.com.
In-store sales and listings on other e-commerce platforms may result in delays in stock updates and the temporary unavailability of certain items featured on Edition-Originale.com.
Any order that cannot be fulfilled due to an error in description, pricing, or availability will be fully refunded, but shall not give rise to any further compensation.

 

3. Guarantee

Librairie Le Feu Follet – Edition-Originale.com undertakes to refund any item that does not conform to its description and accompanying photographs.

Librairie Le Feu Follet – Edition-Originale.comguarantees the proper delivery of all orders and will issue a full refund in the event of loss or damage caused by the carrier.
In the event of a dispute, the carrier’s delivery records shall be deemed authoritative.

 

4. Pricing

All prices are listed in euros (€) and include all applicable taxes (TTC).
Shipping fees are not included and will be added at checkout (see Shipping section).

In accordance with Article 297 D of the French General Tax Code, VAT is not deductible.

Prices displayed on Edition-Originale.com are indicative and subject to change at any time.
No technical or typographical error may give rise to a claim on the part of the customer, nor shall such an error incur the liability of Librairie Le Feu Follet – Edition-Originale.com.
The final sale price of an item is the one shown on Edition-Originale.com at the time the order is placed (except in the case of a typographical error).

 

5. Orders

Validation of the order commits the buyer to the full payment of the total amount due. A confirmation email is sent to the buyer upon completion of the order.

Librairie Le Feu Follet – Edition-Originale.com reserves the right to refuse any order for legitimate reasons.

No item shall be handed over or shipped to the customer until full payment has been received for the item and any applicable delivery charges. Librairie Le Feu Follet – Edition-Originale.com reserves the right to suspend the processing or delivery of any order in the event of a refusal of payment authorization by credit card or any other approved payment provider, or in the case of non-payment and/or fraud. The company also reserves the right to initiate proceedings against any individuals involved in fraudulent activity. In particular, Librairie Le Feu Follet – Edition-Originale.com reserves the right to refuse to ship or fulfil an order from a client who has not paid in full or in part for a previous order, or with whom a payment dispute is pending.
Librairie Le Feu Follet – Edition-Originale.com also reserves the right to take legal action in response to any attempt to use fraudulent payment methods and/or to resolve such cases amicably, provided the client agrees to pay the outstanding amount along with any applicable administrative fees.

Ownership of the items remains with Librairie Le Feu Follet – Edition-Originale.com until full payment has been received. The right of recovery applies both to the items themselves and to their resale price if they have already been resold (pursuant to the law of 12 May 1980).

 

6. Payment

Orders must be paid in euros (€) using one of the following secure methods:

  • Credit card: Carte Bleue, Visa, Mastercard, American Express.
    For credit card payments, your account will be debited once the transaction has been authenticated (notably via your bank’s 3D Secure system) and confirmed on Edition-Originale.com.

  • Cheque: Payments by cheque are accepted in euros only and must be drawn on a bank domiciled in France or Monaco.
    Cheques are cashed upon receipt. They must be made payable to Librairie Le Feu Follet.

  • Bank transfer: All bank charges related to the transfer must be borne by the payer.

  • Apple Pay

  • Google Pay

  • PayPal

  • Cash: Cash payments are accepted only for in-person collection, and within the legal limit defined by the French Monetary and Financial Code (Article D112-3).

7. Delivery

Delivery times and methods are specified at the time of ordering.
Librairie Le Feu Follet – Edition-Originale.com makes every effort to honour the indicated delivery times but cannot be held responsible for delays attributable to postal services or other delivery providers.

 

8. Right of Withdrawal

In accordance with applicable legislation, the buyer has a period of 14 days from receipt of the goods to exercise their right of withdrawal, without having to provide justification, provided that the items are returned complete and in perfect condition no later than 7 days after notifying Librairie Le Feu Follet – Edition-Originale.com of their decision to withdraw.

The right of withdrawal may only be exercised following written notification to Librairie Le Feu Follet – Edition-Originale.com, either by email, post, or via the online contact form.

The packaging of returned items is the sole responsibility of the buyer, who must take all necessary precautions to protect the goods from any damage during transit, in view of the delivery method used.
Librairie Le Feu Follet – Edition-Originale.com cannot be held liable for loss or theft during return shipping.

A refund will be issued within 7 days of receipt of the returned goods, provided they meet the above-mentioned conditions.

Due to the unique nature of certain unpublished manuscripts, such items may be excluded from the right of withdrawal, as their disclosure may affect their intrinsic value. Librairie Le Feu Follet – Edition-Originale.com remains at your disposal for any further information.

 

9. Gift Card

Gift Cards are issued exclusively by Librairie Le Feu Follet – Edition-Originale.com.
The purchase or use of a Gift Card implies full acceptance of the website’s terms and conditions of sale and use. All usage conditions apply to the extent permitted by law.

The Gift Card is non-modifiable, non-exchangeable, non-refundable, and may not be transferred for value.
Gift Cards are valid for a period of one year from the date of purchase.

Any reproduction or falsification of a Gift Card is strictly prohibited.
In the event of doubt regarding the validity or authenticity of a Gift Card, Librairie Le Feu Follet – Edition-Originale.com reserves full authority to resolve the dispute.

 

10. Certificate of Authenticity

Librairie Le Feu Follet – Edition-Originale.com is a member of the French Antiquarian Booksellers’ Association (SLAM), the International League of Antiquarian Booksellers (ILAB-LILA), and Pascal Antoine, founder and director of the bookshop, is a member of the Compagnie Nationale des Experts (CNE).

Librairie Le Feu Follet – Edition-Originale.com offers for sale only original documents authenticated either by its in-house experts or, for certain graphic works, by recognized specialists.

Subject to the conditions outlined below, Librairie Le Feu Follet – Edition-Originale.com guarantees the authenticity and conformity to description of the items sold on Edition-Originale.com. This authenticity is guaranteed on the invoice, and upon request, a certificate of authenticity (without mention of price) signed by Pascal Antoine, expert member of the CNE, may also be provided.

Librairie Le Feu Follet – Edition-Originale.com reserves the right to reject any claim under the Certificate of Authenticity if:

  • The item’s catalogue description conformed to scholarly or expert opinion that was generally accepted, known, or communicated privately at the time of sale, or if the description indicated that such opinions were in conflict;

  • The inaccuracy of the description does not result in a significant loss of value;

  • The claim concerns restoration work carried out for the preservation or enhancement of the item;

  • The issue in question was clearly stated in the item’s description;

  • The item has been altered since purchase;

  • The claim is made after the legal limitation period established by Article 2232 of the French Civil Code (twenty years).

Subject to the foregoing, if Librairie Le Feu Follet – Edition-Originale.com reasonably determines that the item is not authentic, the transaction will be cancelled and the buyer refunded.

 

11. Governing Law and Jurisdiction

These terms and conditions are governed by French law.
Any dispute relating to the use of the website shall fall under the exclusive jurisdiction of the French courts.
